% 29.09.2016 By the present petition the petitioner seeks parole on the ground that he has to file Special Leave Petition against the order dated 19th February, 2016 passed by this Court upholding the conviction of the petitioner for offence punishable under Section 376 IPC.
A status report has been filed. As per the status report the family of the petitioner comprising of his wife and children are residing at H.No. 4/1835, Gali No.4, Rama Block, Bholanath Nagar for the past 9 years as tenant. The petition is opposed on the ground that the petitioner was earlier involved in two cases under Section 25 Arms Act. W.P.(CRL) 2252/2016
A perusal of the nominal reveals that the petitioner has already undergone the two sentences and even in the present case the remaining sentence of the petitioner is around seven months. Considering the facts that the petitioner needs to avail his remedy of filing a Special Leave Petition and the petitioner has roots in the society, I deem it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court/ CMM/ Duty Magistrate.
Petition is disposed of.
Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
