% 03.08.2016 Counsel for the petitioner-Kanwal Kumar states that in view of the orders passed today in W.P.(C) 94/2015 titled as Dinesh Gupta vs. Registrar of Cooperative Societies, Delhi & Ors. and WP(C) No.7460/2015 titled as M/s. New Modern Co-Op. G/H Society Ltd. vs. Sh. Dinesh Gupta and Anr., he would withdraw the present writ petition with liberty to initiate proceedings under Section 70 of the Delhi Cooperative Societies Act or any other provisions in accordance with law.

We accepted the prayer.

In case, proceedings are initiated within a period of three weeks from today, the said proceedings would not be dismissed on the ground of limitation.

The water and electricity connection of the petitioner-Kanwal Kumar would not be disconnected to enable Kanwal Kumar to obtain interim orders in the proceeding to be initiated. This interim order will continue to be in force till it is vacated or modified in the proceedings to be initiated subject to the condition that Kanwal Kumar would initiate the said proceedings within a period of three weeks from today.

It is clarified that this Court has not expressed any opinion on merits.

With the aforesaid observations, the writ petition is dismissed as withdrawn.
