% 08.08.2016 C.M. No.28487/2016 (for preponement) & W.P.(C) 6597/2016 & C.M. No.27080/2016 Petitioner is stated to be a squatter squatting at Gandhi Market, Sagar Pur, New Delhi since 1998. Certain documents which as per the respondent no.1 are prosecution challans only in support of the averments in the petition have been placed on record. The petitioner has admittedly been removed from the site on 21.7.2016. Learned counsel for the respondents has put in appearance. Submission of learned counsel for respondent no.1 is that the petitioner was creating nuisance at this site. Contention of the petitioner is that a urinal has been built up by the Department at this site. His additional submission is that SDMC is not looking after illegal construction.

Be that as it may, noting the submission of the learned counsel for the petitioner that the petitioner is protected under Section 3 (3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, this petition is disposed of with liberty granted to the petitioner to get his grievance addressed before the Town Vending Committee (TVC) of the respondent no.1.

No further orders are called for.

Petition as also the pending applications are disposed of. Date of 07.10.2016 stands called.
