We have heard counsel for the parties.

The record of the Airport Authority of India (AAI) has been produced. The appellants' submissions that the 14 questions which were taken into consideration but were deemed out of syllabus by the concerned Committee, is no doubt borne out by the record. At the same time, this Court is of the opinion that there are no discernible standards which can be applied to hold that the consideration of the Committee's recommendations by the AAI was in a palpably arbitrary manner so as to declare the results to be irregular or illegal.

During the course of hearing, the counsel for the AAI submitted that from the examination process 50 candidates were declared successful and out of whom 49 reported on appointment and that the balance 77 posts along with others were advertised in January, 2017. The total posts advertised are 103 (i.e. 89 General, 9 Scheduled Castes and 5 Scheduled Tribes). 4.

Counsel for the AAI submitted, however, that even though the last date for filling the application to compete for this examination has since gone-by, the present appellants would be afforded a chance. The AAI shall issue an appropriate corrigendum enabling the appellants to apply, if they so desire, within two weeks from today.

Counsel for the AAI also submitted that the entire process of examination and its evaluation would be completed by 31.12.2017. In the light of the above developments and directions, this Court is of the opinion that nothing further needs to be done in the appeal which is accordingly dismissed.
