BAIL APPLN. 1522/2016 The present application has been preferred to seek anticipatory bail apprehending arrest in case FIR No.272/2016 under Section 323/452/34 registered at PS Swaroop Nagar. Two bail applications preferred by the applicant have already been rejected by the learned ASJ. The injury suffered is grievous in nature. Photographs of the injury have also been

shown to the court. This case brings out the mindset of the applicant and his father who is the root cause for the dispute. According to the complaint made by the complainant, the father of the applicant was urinating openly in front of the complainant's premises. Upon being objected to, not only the father raised a quarrel, he also called his son and the complainant was assaulted by use of metallic/ iron piece resulting in grievous injury.

Even today, the attitude of the father of the applicant, who is present in court and the counsel is defiant, and they are seeking to justify their conduct. Learned counsel for the complainant submits that the complainant is receiving threats even today and that they would be taken care of if they do not withdraw their complaint.

In my view, the applicant cannot be granted any protection in this background. Dismissed.
