O R D E R

% 14.09.2018 By this petition, the petitioner seeks modification of the order dated 2nd April, 2018 granting 1st spell of furlough to the petitioner for a period of three weeks as the petitioner is unable to furnish the surety bond for a sum of `10,000/-. The petitioner prays that he be permitted to be released on cash surety along with the personal bond for the like amount. A status report has been filed. As per the status report the petitioner's father along with his brothers and their families is residing at Aligarh and doing business there. Further the wife of the petitioner is residing at village Hastsaal village with two children of the petitioner. W.P.(CRL) 2419/2018

Petitioner was earlier granted parole wherein his sister stood surety for the petitioner. Learned counsel for the petitioner submits that brother-inlaw of the petitioner is now objecting to the petitioner's sister standing surety for him.

Be that as it may the petitioner has his brother, father and wife in the family who can stand surety for the petitioner. Considering the facts noted above this Court finds no ground to modify the order granting 1st spell of furlough. Petition is dismissed.

Copy of this order be communicated to the petitioner through superintendent, Mandoli Jail.
