CORAM:
HON'BLE MR. JUSTICE S.P.GARG
O R D E R
% 10.01.2017 1.
Present Writ Petition under Article 226 and 227 of the Constitution of India r/w Section 482 Cr PC has been preferred by petitioner for quashing of FIR No.
581/2016 under Section 354/354(D)/323/506/509 IPC registered at Police Station Mukherjee Nagar. It is stated that the matter has been settled with the complainant amicably.
2.
On the perusal of the file, it revealed that there was another victim-Shambhavi Singh. Shambhavi Singh has filed an affidavit to
report settlement. She is present before the Court. Respondent No.2/complainant is also present before the Court along with her counsel. The Investigating Officer present in court has identified both the victims. I have inquired from the victims i.e. respondent no.2 and Shambhavi Singh whether the matter has been settled with the petitioner amicably without any fear or pressure. Both the victims have submitted that the matter has been settled with the petitioner amicably and they have no objection to the quashing of FIR. 3.
Since the victims have voluntarily settled the matter with the petitioner, no useful purpose will be served to continue with the proceedings. In the interest of justice and to put an end to the litigation, FIR No. 581/2016 under Section 354/354(D)/323/506/509 IPC registered at Police Station Mukherjee Nagar and all the proceedings emanating therefrom are quashed.
4.
The petitioner is, however, burdened with costs of `15000/- to be deposited with Prime Minister's Relief Found within two weeks. The Registry shall ensure the compliance of the order. 5.
The petition stands disposed of.
