% 27.07.2018 Learned counsel for the respondent is present on advance notice. CM APPL. 29725/2018 and CM APPL. 29726/2018 (exemptions) Exemption allowed subject to all just exceptions. The application is disposed of.

CM(M) 848/2018 Vide the present petition, the petitioner seeks the waiver of reduced costs of Rs.3,000/- as imposed vide order dated 08.09.2017 of the ADJ-05/West, Tis Hazari Courts, Delhi, which costs in terms of the order dated 24.07.2017 of this Court in CM(M) No. 760/2017 whereby it was observed to the effect that it would be open to the petitioner to make a request for reduction / waiver of the costs qua the costs imposed vide order dated 12.05.2017 to the tune of Rs.5,000/- as observed vide order dated 24.07.2017 of this Court, which costs were imposed for non cross CM(M) 848/2018

examination of the witness of the plaintiff on the date 12.05.2017, submitting to the effect that the applicant / petitioner is very poor and earns only Rs.7,500/- per month as per income certificate issued by the Revenue Department, Government of NCT of Delhi, Office of the District Magistrate, Rajouri Garden, West District indicating to the effect that his family income from all sources as declared by him is Rs.90,000/- per annum and that he has to look after his wife, old father and two children and that the costs be thus waived.

On behalf of the respondent, learned counsel for the respondent submits that the costs imposed have not been paid since the date 12.05.2017 nor after reduction thereof vide order dated 08.09.2017. Taking the income certificate of the petitioner on record, which is an official document, the costs imposed vide order dated 08.09.2017 by the Trial Court are reduced to Rs.2,000/- to be paid forthwith to the respondent, which has now been paid to the learned counsel for the respondent and thus the petition is disposed of accordingly.
