O R D E R

% 16.01.2019 Vide the present petition, the petitioner has sought a direction to the respondent no.1 to initiate appropriate action including demolition action against the unauthorised construction being carried out by the respondent no.2 in House No.151/28, Chiranji Gali No.2, Main Road, Mandawali, Delhi. Even though no notice in the present petition has been issued till date, a status report has already been filed by the respondent no.1 pointing out that they have already booked the unauthorised construction under Section 343 and 344(1) of the Delhi Municipal Corporation Act and have initiated appropriate demolition action.

Learned counsel for the respondent no.1 further states that some portion of the unauthorised construction already stands demolished on 22.11.2018 and the respondent will take appropriate action in

accordance with law expeditiously.

In view of the aforesaid statement made by learned counsel for the respondent no.1, learned counsel for the petitioner does not press the present petition any further but prays that the respondent no.1 be directed to complete the requisite action in a time bound manner. The writ petition is accordingly disposed of as infructuous along with the pending application. In case the respondent no.1 does not complete the requisite action within a period of six months, the petitioner will be at liberty to take legal recourse permissible under law.
