% 15.01.2016 CM No.1409/2016 This is an application under Section 151 CPC filed on behalf of the petitioner for withdrawal of the present petition. For the reasons given in the application, the same is allowed. Accordingly, the application stands disposed of. W.P.(C) 8865/2008 The petitioner has filed the present petition challenging order No.HARDICON/PERS/ADMN/2008/4510 dated 08.10.2008 passed by respondent No.2. The petitioner has also challenged order dated 04.11.2008 passed by respondent No.2/ Manager, Hardicon Ltd. New Delhi.

Learned counsel for both the parties submits that the parties have entered into settlement before the Mediator, Mediation Centre,

Saket Courts, New Delhi on 15.10.2015.

A copy of settlement dated 15.01.2015 has been filed along with withdrawal application.

Learned counsel for the petitioner submits that the petitioner does not want to pursue the present petition in view of the settlement dated 15.10.2015 and seeks permission to withdraw the present petition with liberty to move an application for revival of the petition in case respondent No.1 violates any terms of the settlement dated 15.10.2015.

Statement of the petitioner has been recorded separately to this effect.

In view of the above, the present petition is dismissed as withdrawn.

However, both the parties are at liberty to move an application for revival of the petition in case, any of the parties violate the terms of the settlement dated 15.10.2015 executed before the Mediator, Mediation Centre, Saket Courts, New Delhi. V.P.VAISH, J JANUARY 15, 2016/gm
