HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 03.08.2016 Petitioner no.1 and respondent no.2 were married on 14th February, 2013 as per Hindu Rites and Ceremonies. Petitioner no.2 to 4 are the relatives of petitioner no.1. Marital discord between petitioner no.1 and respondent no.2 has led to the registration of present FIR. Petitioner no.1 and respondent no.2 have settled their disputes amicably vide settlement deed dated 20th November, 2015 (Annexure P-7). Terms of settlement are stated to have been complied with. Marriage of petitioner no.1 and respondent no.2 has already been dissolved vide a decree of divorce dated 13th July, 2016. Respondent no.2 is present in Court along with her counsel
and has been identified by W/ASI Urmila Singh PS Greater Kailash. Respondent no.2 admits having received the entire settled amount. Photocopy of demand draft is taken on record. She further submits that she has no objection, in case the present FIR is quashed. Keeping in mind the facts that petitioner no.1 and respondent no.2 have settled their disputes amicably and the marriage between them has already been dissolved vide a decree of divorce, no fruitful purpose would be served by keeping the criminal proceedings pending. Accordingly, the present FIR No.76/2015 under Sections 498A/406/34 IPC registered at police station Greater Kailash and the consequent proceedings emanating therefrom are quashed against all the petitioners. Writ petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
