1. This is an appeal by the Revenue against the order dated 4th March 2016 passed by the ITAT in Stay Application No. 133/Del/2016 of ITA No. 1102/Del/2015 for the Assessment Year 2010-11.

2. The question raised by the Revenue is whether the extension of stay by the ITAT for a further period of 6 months is in contravention of Section 254 of the Income Tax Act, 1961?

3. Admittedly the issue stands answered against the Revenue by the decision of this Court in Pepsi Foods Pvt. Ltd. v ACIT, [2015] 376 ITR 87 (Del).

4. The appeal is accordingly dismissed.
