% 01.08.2016 Crl.M.A. 11655/2016 Exemption allowed subject to just exceptions. CRL.M.C. 2719/2016 By this petition the petitioner seeks quashing of FIR No. 19/2014 under Sections 498A/406/34 IPC registered at PS Dwarka North, Delhi on the complaint of respondent No.2.
Notice. Learned APP for the State accepts notice. On instructions from the investigating officer he states that the petitioner is the only accused in the charge-sheet as his mother was kept in column No.12 and the respondent No.2 only victim/complainant in the above-noted FIR. The complainant/Respondent No. 2 who is present in Court and is identified by the Investigating Officer states that she has settled the matter CRL.M.C. 2719/2016
with the petitioner and is living with him in the matrimonial home. She states that she does not want to pursue the FIR and the proceedings pursuant thereto.
Since the parties have amicably resolved their difference and the pendency of the present proceedings will bring further acrimony and disharmony between the two, it would be in the interest of justice if the present FIR is quashed.
Accordingly, FIR No. 19/2014 under Sections 498A/406/34 IPC registered at PS Dwarka North, Delhi and the proceedings pursuant thereto are quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
Petition is disposed of. Order dasti.
