% 15.05.2017 The petitioner is first informant of case FIR No.517/2015, under Section 365/34 of the Indian Penal Code, 1860 (IPC) registered with Police Station Sangam Vihar, New Delhi respecting alleged abduction of his son Avneesh reported on 13.06.2015, investigation whereof eventually brought out the fact that his dead body had been recovered on railway lines on 06.05.2015 in the area of Palghar Railway Police Station in Maharashtra. He has been dissatisfied with the course of investigation and has moved the present petition seeking it to be handed over to Central Bureau of Investigation (CBI) or any other independent agency. On the request of the Additional Standing Counsel (ASC), the matter was passed over after some hearing. When the matter is taken up again, it has been submitted by the ASC for respondent State that the supervisory police officers are agreeable to transfer the investigation of the above mentioned FIR to District Investigation Unit (DIU), with further assurance that all the inputs given by the petitioner (the first informant) would be W.P.(CRL) 1074/2017

thoroughly probed and that he would be kept in the loop at all relevant/material stages of investigation including about the submission of the report of investigation under Section 173 Cr.P.C. The counsel for the petitioner is satisfied with this assurance and seeks to presently withdraw the petition.

The petitioner is disposed of accordingly.
