% 25.10.2016 C.M. No.37836/2016 (for release of surety bond by respondent No.1) 1.

Since the land acquisition appeal has been decided in favour of the respondent no.1 inasmuch as the enhanced compensation is granted, whatever has been granted by the land acquisition court below was also available to the respondent no.1 towards compensation of acquired land. 2.

Vide order dated 8.3.2010, the amount deposited in this Court by the appellant was directed to be released to the respondent no.1 on furnishing surety to the satisfaction of the Registrar General of this Court

and respondent no.1 filed the surety bond which was accepted by this Court vide order dated 16.3.2010.

In view of the above, the surety bond given by the respondent no.1 would stand discharged as the land acquisition appeal has been allowed by enhancing compensation granted by the land acquisition court and therefore the amount granted by the land acquisition court would, in any case, be the decretal amount in favour of the respondent no.1. C.M. stands disposed of.
