% 26.07.2018 Learned counsel appearing on behalf of the petitioner, after some arguments, seeks leave to withdraw this petition with liberty to institute an appeal, impugning the assessment order dated 18.06.2018, before the newly constituted Municipal Taxation Tribunal, in accordance with the mandate of the provisions of Sections 169 and 170 of the Delhi Municipal Corporation Act, 1957.

Leave and liberty granted.

The petition is dismissed as withdrawn and disposed of accordingly. The pending applications also stand disposed of. Needless to state that the Municipal Taxation Tribunal, if and when a statutory appeal is instituted on behalf of the petitioner, determine the same, FAO(OS) 7753/2018

in accordance with law and in terms of the decision of a Division Bench of this Court in W.P.(C) 6417/2015, titled as 'Springdales School vs. North Delhi Municipal Corporation & Ors.'.
