% 02.08.2016 The impugned order dated 12.5.2016 is not a judgment which can be made subject matter of the challenge under clause 10 of the Letters Patent. The order dated 12.05.2016 records prima facie view and the appellant herein has been asked to examine and take instructions.

We clarify that we have not expressed any opinion on merits and in case of an adverse final order/judgment, the appellant would be entitled to challenge the judgment in accordance with law. With the aforesaid observation, the "appeal" is dismissed as not maintainable.
