% 19.01.2018 Learned counsel for the petitioner submits that his prayer in the petition is confined to land measuring 5 bighas 6 biswas in Khasra No.338, which is Gaon Sabha land. The said position is not disputed by Mr. Naushad Ahmed Khan, learned counsel appearing for respondent nos. 1 & 2.
Mr. Ranjan Kumar, learned counsel appearing for applicants in C.M. No.16875/2014, submits that though the applicants have not yet been impleaded as parties in the present petition, but even these applicants are concerned only with Khasra No.339 and having nothing to do with the Khasra No.338, in respect of which the present
petition has been filed. Similarly, Mr. Mr.Pankaj Vivek, counsel appearing for respondent nos. 5 and 6 also makes a similar statement that the respondent nos. 5 and 6 have nothing to do with Khasra No.338.
In view of this, Mr. Naushad Ahmed Khan, appearing for respondent nos. 1 & 2 very fairly submits that within three months they will have the encroachment, if any, removed, from Khasra No.338 situated in revenue estate of Village Dindarpur, Delhi. Mr.Pankaj Vivek counsel appearing for respondent nos. 5 and 6 submits that he is in Khasra No.339 as per the demarcation report dated 27.06.2014. It is made clear that the respondent nos. 1 to 4 before carrying out removal of encroachments will take care of all the demarcation reports.
In view of the aforesaid statements made by learned counsel for the respondents the learned counsel for the petitioner does not wish to press the present petition.
While binding the parties to the statements made by them, the writ petition is disposed of in the above terms. REKHA PALLI, J JANUARY 19, 2018 sr
