% 11.02.2016 Present writ petition has been filed with the following prayers:- " 1.

to issue a Writ of Mandamus or any other appropriate Writ against the Respondent thereby directing the Respondent to pay damages amounting to Rs.100 Crores jointly to the Petitioners.

Any other relief or reliefs which this Hon'ble Court may deem fit and proper under the facts and circumstances of the present case may also be granted in favour of the Petitioner." This Court on 25th January, 2016 was of the view that disputed questions of fact are involved in the present writ petition.

Petitioner has now filed an application for withdrawal of the present writ petition with liberty to file a civil suit. Today, learned counsel for petitioner does not wish to press CM Appls. No.4027-4028/2016 in the present writ petition.

Consequently, present writ petition and applications are dismissed as withdrawn with the aforesaid liberty. However, to facilitate filing of the civil suit, it is clarified that the time spent in prosecuting the present proceedings shall stand excluded while determining the period of limitation for the fresh proceedings to be initiated by the petitioner.
