% 17.11.2017 By these petitions, petitioners have prayed for quashing of the following cross FIRs, details whereof are as under:-
(a) FIR No. 346/2008 under Sections 420/468/471/120B/448/506 IPC is registered at Police Station Sangam Vihar, on the complaint of Ritesh Kumar (respondent no. 3) in Cr1. M.C. no. 1459/20 17 and petitioner no. 2 in Crl.M.C. no. 1453/2017; and (b) FIR No. 334/2010 under Sections 323/427/452/34 IPC registered at Police Station Sangam Vihar on the complaint of Sameen Bhai (respondent no. 3) in Crl.M.C. no. 1453/2017 and petitioner no. 1 in Cr1. M.C. No. 1459/20 17.
It is submitted that petitioners (accused) and respondent no.3 (complainants) in both the petitions were known to each other and living in the same locality. A perusal of FIRs shows that a quarrel took place between them on some trivial issue, which led to the registration of aforesaid cross FIRs. It is further submitted that Petitioners and private respondents have now settled their disputes amicably with the interventions of their common friends and other family members in order to maintain harmonious relations in future. They say that they have settled the matter of their own free will, voluntarily and without any undue force, pressure or coercion. Complainants Ritesh Kumar and Sameen Bhai are present in Court and have been identified by S.I. Abhishek of police station Sangam Vihar.
They submit that they are not willing to pursue the FIRs any further and both the FIRs may be quashed.
Keeping in view the above fact that a quarrel took place between petitioners and private respondents on some trivial issue and they have now settled their disputes amicably in order to maintain harmonious relations in future, in the interest of justice, FIR No. 346/2008 under Sections 420/468/471/120B/448/506 IPC and FIR No. 334/2010 under Sections 323/427/452/34 IPC, both registered at Police Station Sangam Vihar and the consequent proceedings emanating therefrom are quashed.
