% 05.08.2016 Learned counsel for the appellant, on instructions from the appellant and after seeking time for consideration after pass-over, states that the present appeal is not pressed, more so because the original judgment and decree was challenged by the appellant right up till the Supreme Court but the appellant was not successful, and, in fact the first appeal filed resulting in the impugned order dated 9th June, 2016 was not maintainable as the order of the learned trial Court dated 22nd October, 2013 itself was not appealable. This appeal is accordingly disposed of as not pressed, and in case the appellant gives an undertaking before the learned trial Court to vacate the premises in around three months or so, the learned trial Court will liberally consider that request.
