O R D E R

% 24.05.2018 Learned Senior Counsel appearing on behalf of the parties, on instructions from the latter, who are present in person in Court today, state that they have arrived at an amicable settlement of all the underlying matrimonial disputes on the following terms and conditions:- i. Respondent (Husband) shall pay a lumpsum amount of Rs.1.75 crores to the Appellant (wife) by way of demand draft/pay order towards all past, present and future claims, including permanent alimony and arrears of maintenance pending execution in Tis Hazari Court.

ii. The amount of Rs.1.75 crores shall be paid in following manner:- a.

Respondent undertakes to this Court to pay the Appellant Rs.2 lakhs within two days from today, and to deposit Rs.98 lakhs before this Court within one month from today. b.

Appellant undertakes to this Court that she will vacate the house of Respondent's mother (52, Mausam Vihar), within two months from the date of the said deposit of Rs.98 lakhs, by way of demand draft/pay order in the name of the Registrar General of this Court and upon vacation of the said house, the appellant shall be entitled to withdraw Rs.98 lakhs from the Court. c.

Appellant undertakes to appear and withdraw her appeal being RFA No.136/2013 from the High Court today itself, as well also the execution proceedings pending before the Civil Judge, Tis Hazari.

Respondent undertakes to this Court to pay Rs.50 lakhs to the appellant within seven months from today. e.

Respondent also undertakes to pay the balance Rs.25 lakhs within twelve months from today.

Respondent also undertakes to transfer the ownership of Santro car bearing registration No.DL2C8335, which is already in the appellant's possession, into the name of the appellant, within three months from today, in accordance with law. In terms of the amicable settlement arrived at by and between the parties, as hereinabove elaborated, and subject to the performance of their reciprocal obligations thereunder, learned counsel appearing on behalf of the appellant seeks leave to withdraw this appeal.

The appeal along with the pending applications is disposed off. The undertakings given on behalf of the parties are hereby accepted, directing them to comply with their obligations under the amicable settlement, without demur.
