O R D E R
% 16.08.2018 Mr. Sood, the learned Senior Counsel for the petitioner submits that despite best efforts, the petitioner may not be able to repay the entire Rs.14 lacs, according to the schedule fixed in the previous order. However, a sum of Rs.3 lacs has been paid to the respondent by way of online transaction in the bank account of the complainant today.
Therefore, he seeks an extension of time for payment of the said amount till February, 2019.
In view of above, the repayment of the remaining amount would be made in four equal instalments of Rs.2.75 lacs each. The first instalment would be paid on 25th September, 2018. The other
subsequent instalments would be paid on 25th day of October, November, December, 2018 and 25th February, 2019. In view of the previous order and in the aforesaid circumstances, the petitioner is enlarged on bail on his furnishing a personal bond in the sum of Rs.40,000/- with one surety of the like amount to the satisfaction of the Trial Court concerned, subject to the following conditions:- (i) the petitioner will regularly appear on each and every date of hearing to be fixed by the Trial Court concerned; (ii) the petitioner will not try to influence, contact or meet the complainant and prosecution witnesses in any manner; (iii) the petitioner will not leave the country without prior permission of the Court and the passport, if any, shall be deposited with the Trial Court concerned; and (iv) in case of change of his new address or contact number, the petitioner will promptly intimate to the SHO/IO of the case and intimate the Trial Court.
Nothing stated in this order shall be deemed to be an adjudication on the merits of the case.
The Registry is directed to send a copy of this order to the Jail Superintendent, concerned for compliance. Additionally, a copy of the same shall also be delivered upon the Jail Superintendent through the police.
It is clarified that in case, there is any default in the repayment of the instalments by the petitioner, it would be open to the IO or the
Complainant to move to the Court for cancellation of bail of the petitioner.
The petition stands disposed-off in the above terms. A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. NAJMI WAZIRI, J.
