% 07.11.2017 Present suit had been filed in forma pauperis by the petitioner on 10th April, 2015.

On the first date of hearing i.e. 13th May, 2015, learned Predecessor of this Court had observed that on a perusal of averments made in the plaint, it appears that the suit is barred by limitation. A perusal of the paper book reveal that since 13th July, 2015, the petitioner has been taking repeated adjournments to file an amendment application. Even on 11th July, 2017 the matter had been adjourned to allow the petitioner to re-file the amendment application within two weeks. Till date, the amendment application is not on record. Today also, learned counsel for petitioner prays for some additional time to place on record the amendment application.

As the amendment application has not been brought on record for the last more than two years, this Court is of the view that the petitioner is not serious in prosecuting the present case.

Consequently, present petition is dismissed in default and on account of non-prosecution.
