% 16.04.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the application filed therewith and instead be given liberty to agitate the issue of limitation at the trial where the liability, if any, would be determined. It will have to be borne in mind that the observations recorded by the trial Court in the impugned order were for disposal of the application under Order 7 Rule 11 CPC and, therefore, cannot be treated as final expression of opinion on merits.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
