% 09.08.2016 Crl. M.A. No. 12212/2016 (Exemption) Allowed, subject to all just exceptions.

CRL.M.C. 2848/2016 Learned counsel for the petitioner at the outset submits that after the learned Magistrate reserved the application seeking interim maintenance for orders, the son of the petitioner was admitted into school and thus the expenses have increased manifold. Since there are new circumstances now which entitle the petitioner to claim further maintenance for the child the petitioner will move an application for enhancement of the interim maintenance before the learned Metropolitan Magistrate. Learned counsel seeks leave to withdraw the present petition with liberty to file a fresh application before the learned Metropolitan Magistrate. Leave and liberty granted. Petition is dismissed as withdrawn. MUKTA GUPTA, J.
