% 05.10.2018 The learned counsel for respondents No. 1 and 2 states upon instructions that, in the first instance, the petition is not maintainable since the petitioner has an equally efficacious alternative remedy available under section 156(3) Cr.P.C. Secondly, he submits that according to the available information, there has been no breach of any Official Secret of the Government of India, in particular, of the Ministry of Home Affairs and the National Investigating Agency, apropos the programme telecast by television channel through respondent nos. 3 to 5 on 31.08.2017 followed by 27.09.2017.
In view of the above, the learned counsel for the petitioner seeks to withdraw the petition with liberty to pursue his remedies, as may be available in law.
The petition is dismissed is withdrawn accordingly. Liberty granted.
A copy of this order be given dasti to the learned counsel for the parties under signature of the Court Master.
