After arguments, this appeal is disposed of with the consent order that the respondent/plaintiff will receive from the appellant/defendant a sum of Rs.5 lacs in full and final settlement of all claims of the respondent/plaintiff in the subject suit. The amount of approximately Rs.5,80,000/- has been deposited in this Court and therefore respondent/plaintiff will receive a sum of Rs.5 lacs alongwith accrued interest on the amount of Rs.5 lacs and the balance principal amount deposited in excess of Rs.5 lacs alongwith accrued interest be released to the appellant/defendant. 2.

On the aforesaid amount being received by the respective parties no claim of any of either party against other will survive with respect to the cheque bearing no.837856 drawn on State Bank of India, Nangli, Sakrawati

Branch, Delhi.

The appeal is disposed of in terms of the aforesaid consent order, leaving the parties to bear their own costs.
