1. The report received from the Delhi High Court Mediation and Conciliation Centre records that the parties have settled their disputes in respect of the claims arising out of the decree and final judgment dated 18th April 2012 in the suit for recovery being CS (OS) 1990/2009, re-registered as CS (COMM) No. 1295/2016. In terms of the said settlement, the Respondents have agreed to pay a sum of Rs. 12775000/- to the Decree Holder in three instalments as under:
"(a) A sum of Rs. 20,00,000/- (Rupees twenty lakhs only) which has already been paid by the second party to the first party in the month of November 2019 via bank transfer shall be treated as the "First Instalment".
(b) A sum of Rs. 20,00,000/- (Rupees twenty lakhs only) shall be paid by the second party to the First party on or before 30th April, 2019, via bank transfer or a demand draft, which shall be treated as the "second instalment".
(c) The remaining amount of Rs. 87,75,000/- (Rupees Eighty
Seven Lakhs Seventy Five Thousands only) shall be paid by the second party to the First party at the time of recording of statement of the First party before the Hon'ble High Court in the petition for quashing of FIR No. 265/2009 in the form of a demand draft in the name of the First party. The second party undertakes to pay the aforesaid third and final settlement on or before 31st August, 2019."
2. In terms of the aforesaid settlement between the parties, the present petition is disposed of. The parties shall remain bound by the terms of the settlement recorded on 8th March 2019.
