This petition by way of Public Interest Litigation has been filed with the following prayer:

"(a) To scrap the tender No.NIOT/15/848/2014-15 awarded by Respondents No.1 & 2 in favour of respondents No.3 & 4 for design, development, supply and commissioning of manned submersible for 6000 Mtr. water depth application including training & transfer of technology.

(b) To direct the respondents No.1 and 2 to apply set norms/practice adopted by the Government awarding the global tender, so that the public exchequer money is saved.

(c) To include a Government or non-Government organization having expertise in the concerned filed or scientific development.

(d) To order for an investigation on the entire episode by an independent committee."

It is alleged in the writ petition that the project in question was awarded to the respondents No.3 and 4 pursuant to the impugned tender W.P.(C) 7031/2016

which is vitiated for lack of transparency apart from favouritism towards the respondents No.3 and 4.

As we could see, the petitioner has made a detailed representation complaining to the respondent No.1/Ministry of Earth, Science and Technology about the alleged irregularities in the tender process. 4.

The learned counsel appearing for the Union of India states that all the objections raised in the said representation will be looked into and an appropriate order will be passed in accordance with law. The said statement of the learned counsel for the respondent No.1 is placed on record. 5.

The writ petition is accordingly disposed of with a direction that the decision taken by the respondent No.1 shall be communicated to the petitioner on or before 31.12.2016. If the petitioner is still aggrieved, he is at liberty to file a fresh writ petition.
