Transfer, in exercise of powers under Section 24 of the Code of Civil Procedure, 1908 (CPC), is sought of CS No.20/2015 titled "Sushil Kumar Vs. Sunil Kumar & Anr." of the Court of Ms. Shunali Gupta, SCJ-cum-RC (West), Tis Hazari Courts, Delhi to District South-West, Dwarka Courts, New Delhi.

Notice of the petition was ordered to be issued and both the respondents are reported to be served.

However none has appeared on their behalf.

The counsel for the petitioner states that the suit is for declaration of rights in immovable property which is not situated in the district in which the suit is pending.

If that is so, then the petitioner should take an objection in that regard in his written statement to the plaint in the suit and Section 24 of the CPC is not the alternative thereto.

Dismissed.

No costs.
