W.P. (Crl.) No.1094/2017 The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India read with Section 482 Cr.P.C. for violation of his fundamental rights under Articles 14 & 21 of the Constitution of India on the basis of fraud.

After some hearing of the matter, learned counsel for the petitioner on instructions submits that the petitioner would move an application under the Right to Information Act to obtain a copy of the letter of the Russian Customs

which finds mentioned in the Communication dated 29.04.2004 which, according to him, is the basis for all proceedings initiated against him. Counsel further submits that he wishes to withdraw the writ petition at this stage. Mr.Sanjay Jain, learned ASG, who appears on an advance copy, submits that the present petition is a gross abuse of the process of the Court; is not maintainable and should be dismissed with costs. The objections sought to be raised by the learned ASJ are kept open.

As prayed, the writ petition is dismissed as not pressed. Crl. M.A. No.6149/2017 (for stay) Application stands disposed of in view of the order passed in the writ petition.
