The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.496/2013 registered under Sections 498A/406/34 IPC at PS New Ashok Nagar. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file. By an order dated 11.12.2013, the petitioner was granted interim protection and was directed to join the investigation as and when required.

Matter was referred to Delhi High Court Mediation & Conciliation Centre to explore possibility of settlement. Matter could not be resolved there. Vide order dated 05.11.2014, the petitioner was directed to pay `15,000/- per month to the complainant - wife as maintenance. This order was challenged before the Hon'ble BAIL APPLN. 2329/2013

Supreme Court. Vide order dated 15.07.2016, the Hon'ble Supreme Court deleted the said condition.

Learned Addl. Public Prosecutor informs that the charge-sheet has been filed without arrest.

He has no objection to the grant of anticipatory bail.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
