% 02.08.2018 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be permitted to withdraw the captioned petition and the application filed therewith, seeking cancellation of the order dated 21.06.2018 whereby the third respondent has been enlarged on bail by the court of Sessions in case FIR no.117/18 involving offences punishable under Sections 354, 509, 506 IPC of police station H.N. Din, his only apprehension being that the observations on the merits of the case may, in the further proceedings, prejudice the petitioner.
The apprehensions are misplaced for the simple reason, the observations recorded in such an order are always treated as tentative and cannot ever be construed as final expression of opinion on merits.

The petition and the application filed therewith are dismissed as withdrawn.
