% 10.07.2018 Petitioner has participated in the investigation. He has given his specimen handwriting also.
Petitioner has handed over his mobile phone number 99713338068 to the Investigating Officer. Vide order dated 10.04.2016, petitioner was given protection from arrest. Same is still continuing. Petitioner has been operated and his leg has been amputated.
As per the complainant, he received a call on his mobile phone number from mobile number 8800279257. The caller said that he was his friend Ajit Singh. He said that he is sending one person to him and
complainant shall give `10,00,000/- to him on handing one of the property documents. Two persons arrived at complainant's place and one of them disclosed his name as Harnam Singh and handed over 5 blank cheques drawn from the Account No.913010047578016 of Axis bank and property papers.
Accordingly, complainant gave Rs.10 lacs to him. Harnam also signed a receipt which was written by the complainant in his handwriting in Punjabi language.
Learned APP submits that sons of complainant had noted the motorcycle number on which said persons had come. On the basis of motorcycle number, petitioner's identity was disclosed as petitioner was owner of the said motorcycle.
The report of the FSL has already been received.
Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail, subject to his furnishing a personal bond in the sum of `20,000/-(Rupees Twenty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Petitioner shall, however, cooperate in the investigation and appear before the Investigating Officer as and when he is called upon to do so.
Bail application is disposed of in the above terms. Dasti.
