% 08.08.2016 Crl.M.A. 12034/2016 (Exemption) Application is allowed subject to just exceptions. Crl.M.C. 2821/2016 & Crl.M.A. 12033/2016 (Stay) Arguments heard.
The present petition has been filed against the order dated 25.05.2016 passed by the revisional court. The facts in the present case are that one complaint was filed by the respondent no.2 before the Court of learned Magistrate in which an application under Section 156(3) Cr.P.C. was moved which was dismissed. The respondent no.2 filed the revision petition. During the pendency of the revision petition, an application was filed by the petitioner-herein for rejecting the statement dated 17.02.2016 made by him. The said application was dismissed by the revisional court while observing that it did not
see any ground to entertain the application. It was made clear that the respondent/petitioner-herein was having civil remedy and may seek relief from appropriate forum.
In the facts and circumstances mentioned above, this Court does not find any cause of action to move the present petition. The present petition and application Crl.M.A. 12033/2016 are accordingly dismissed.
