O R D E R

% 26.08.2016 Mr.Rahul Mehra, learned senior standing counsel who has been summoned by this Court has disclosed post-lunch that the order dated 30th June, 2016 on the basis of which present contempt petition had been filed had been stayed by the Additional Sessions Judge-03, South East, Saket in CR No.204715/16 on 8th August, 2016. This Court is of the opinion that the said fact should have been disclosed by the counsel for the petitioner when the matter was taken up today for hearing in the morning session.

Be that as it may, since the order in question has been stayed, the present contempt petition is dismissed.

The concerned Additional Sessions Judge is directed to examine the matter from all angles as after reading a copy of the complaint, this Court is of the view that the petitioner himself has 'proudly asserted' in his own complaint that he was a bribe giver.

This Court on questioning the petitioner this morning has also found that though he is not an MBBS doctor, yet he is using the decree of a doctor. This matter requires a thorough investigation as one of the patients of a friend of the petitioner is stated to have lost her life. Although in the complaint it is stated that the said patient lost her life at the hands of accused no.1, yet the matter requires an indepth investigation. The aforesaid aspect shall also be kept in mind by the concerned ASJ while disposing of the civil revision petition. Copies of this order be forwarded by the registry to the concerned ASJ-03, South East, Saket Courts, New Delhi and MM-02, South-East, Saket Courts, New Delhi who is hearing the case being CC No.22/16, PS OIA, under Sections 156(3) Cr.P.C.
