W.P.(CRL) 1061/2017 and Crl.M.A.5969/2017 (stay) On the complaint of respondent no.2, who is father of petitioner no.2, she being married to one Vicky, FIR No.3/2017 has been registered by Police Station GTB Enclave alleging offence under Section 365 IPC having been committed by the first petitioner. By this petition, she with the person accused in the FIR have joined together to come up with a different version. It is not appropriate in the facts and circumstances to invoke writ jurisdiction of this court to seek quashing of the FIR. There is no good reason to make departure from the normal procedure. The second petitioner should rather appear before the investigating officer and give her statement explaining her version.
The petition with application are dismissed.
