O R D E R

% 10.08.2017 The petitioner seeks bail in anticipation of his arrest in connection with the FIR No.132/2017 (P.S. Ranhola) which was lodged by the prosecutrix on 12.03.2017 with respect to an occurrence which had taken place on 19.03.2016 i.e. about a year before. It has been submitted that he has not been named in the FIR.

The petitioner has only been named in the 164 Cr.P.C statement of the prosecutrix and that also in a vague manner. In the aforesaid statement referred to above, it has been alleged that the petitioner along with two others threatened the prosecutrix on point of knife for not communicating about the occurrence to anybody. It has been submitted that two other coaccused persons with similar allegations have been granted bail. Regard being had to the fact that the petitioner was not named in the FIR which was lodged after about an year of the occurrence and the vague

nature of allegation against the petitioner of his trying to threaten/intimidate the prosecutrix and chargesheet having been submitted, this Court is inclined to grant anticipatory bail to the petitioner. In the event of arrest or surrender, the petitioner shall be released on bail on his furnishing a bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the arresting officer/competent Court. However, it is made clear that the petitioner shall participate in the trial and if he absents himself from the trial proceedings for three consecutive occasions, without any reasonable/plausible explanation, it would be open for the Trial Court to proceed ahead for cancellation of his bail.

The application is allowed and disposed of.
