O R D E R

% 07.09.2016 By the present petition, the petitioner seeks regular bail in case FIR No.308/2015 under Sections 420/34 IPC registered at PS Connaught Place. The allegations of the complainant in the above-noted FIR are that he was cheated by the petitioner, Subham Shrivastava and Sashiranjan Kumar with the help of their associates in respect of providing job in Indian Railways. The complainant was asked to deposit `47000/- in different account numbers and the complainant gave money in cash as well totalling a sum of `2.5 lakhs..

Photocopy of the forged appointment letter has been handed over by the complainant during investigation. As per the investigation, a sum of `5000/- was got credited to the account of brother of the petitioner which was withdrawn through ATIM card by the petitioner. The bail of the petitioner is being opposed on the ground that co-

accused Subham Shrivastava and Sashiranjan Kumar have not been arrested so far however the fact remains that charge sheet qua the petitioner has been filed. He has been in custody since 23rd April, 2016 and is no more required for custodial interrogation.

Considering the facts and circumstances of the case, the petitioner is directed to be released on bail on his furnishing a personal bond in the sum of `50,000/- with two sureties of the like amount one of which would be a family member of the petitioner, subject to the satisfaction of learned Trial Court and further subject to the condition that he will not leave the country without prior permission of the Court concerned and in case of change of address, he would inform the same to the learned Trial Court. Petition is disposed of.
