% 13.05.2016 I.A. No. 6030/2016 This application has been jointly moved by the parties to record their settlement under Order 23 Rule 3 CPC. The application is signed by the representatives of the plaintiff and defendant. It is also supported by the affidavit of Mr.Manoj Kumar Singh, the authorized signatory/representative of the plaintiff company and Mr. Bansilal Someshwar Vyas, the proprietor of the defendant firm. The terms of the settlement appear to be just, fair and reasonable. I see no impediment in accepting the same. Consequently, the settlement is accepted and shall continue to bind the parties. The suit stands disposed of in terms of the settlement.
Since the suit stands settled prior to the commencement of the trial, the plaintiff shall be entitled to refund of 50% of the court fee. VIPIN SANGHI, J MAY 13, 2016 sl
