On behalf of the complainant, it has been submitted that the complainant is ready and willing to compound the offence, if the amount deposited by the revisionist is paid to the respondent No.2/complainant. 2.

The petitioner who is present in person agrees to the said settlement, copy of which is placed on record. The complainant/respondent No. 2 has also placed on record his affidavit to the effect that if the amount lying deposited with the Registrar in the form of interest bearing FDR is released in favour of the respondent no.2/complainant along with the interest accrued thereon, the substantive sentence of five months, awarded to the petitioner may be waived.

The petitioner in this case has been convicted for the offence punishable under Section 138 NI Act which is compoundable. 4.

In view of the settlement between the parties, the amount of `3,90,508/- deposited by the revisionists in compliance of order dated 4th September, 2014 along with the interest accrued thereon shall be released to the respondent No. 2/complainant by the Registry. The amount of `5,000/- required to be deposited by the petitioner herein has been agreed to be deposited by the respondent No. 2/complainant with the Trial Court within a period of two weeks from today.

In view of the settlement arrived at between the parties, the accused is acquitted. The parties shall be bound by the terms of the settlement arrived at between the parties.

The revision petition is disposed of accordingly. Copy of the order be given dasti, under the signatures of the Court Master.
