O R D E R
% 18.05.2016 This order is passed in continuation of order dated 4th April, 2016. Both the parties have the affidavits of no objection if Mr.Siddharth Khattar, Advocate is appointed as sole Arbitrator to adjudicate the disputes between the parties including the relief sought in the present petition. With the consent of the parties, Mr.Siddharth Khattar, Advocate (R/o K-12, Kailash Colony, New Delhi, Mob. No.9810700078), is appointed as sole Arbitrator to adjudicate the disputes between the parties. The parties are also allowed to file their respective claims and counter-claims before the Arbitrator.
When the petition was filed interim order was issued against the respondent who was injuncted from interfering with the possession of the petitioner and the said shall continue during the pendency of the arbitration proceedings.
Parties to appear before the Arbitrator on 30th July, 2016 at 4:00 pm for directions.
The arbitration proceedings shall take place in the High Court premises itself. The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration. The fees of the learned Arbitrator is fixed at Rs.1,00,000/- which shall be shared by both the parties in equal proportions. The petition is accordingly disposed of.
Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be delivered to the learned Arbitrator forthwith. MANMOHAN SINGH, J.
