The present petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 seeks appointment of an Arbitrator for adjudication of the disputes which have arisen between the parties in relation to agreement dated 27.04.1994 and 18.07.1994. 2.

The present petition has remained pending for the last almost four years.

Learned counsel for the petitioner submits that during the pendency of the present petition, an Interim Resolution Professional has been appointed qua the respondent/company by an order passed by the National Company Law Tribunal, Bombay Bench. He therefore, seeks leave to withdraw the present petition with liberty to approach the Court again after the conclusion of the proceedings

pending before the National Company Law Tribunal and the insolvency proceedings, if any.

The petition is dismissed as withdrawn with liberty as prayed for.
