Crl. Rev. P. 304/2017 This is a petition moved by the petitioner for setting aside the impugned order dated 03.03.2017 passed by Ms. Shama Gupta, M.M01/NW/Rohini,, Delhi in Complaint Case No. R-14327/2016, under Section 138 N.I. Act.

Learned counsel for the petitioner submits that the petitioner could not appear before the Trial Court on 03.03.2017 due to certain unavoidable circumstances, which resulted into dismissal of the petition of the petitioner. He further submits that the petitioner shall deposit the costs of Rs.3,000/- within a week from today, while praying that the complaint case before the Trial Court be restored.

In view of the submissions of learned counsel for the petitioner, the

present petition is allowed and the impugned order dated 03.03.2017 is set aside and the complaint case before the Trial Court is restored, with the direction to the petitioner to deposit the costs amounting to Rs.3,000/- with DLSA within a week from today.

The petitioner is directed to appear before the concerned Trial Court on 1st May, 2017.

The present petition is disposed of accordingly. Copy of this order be sent to the concerned Trial Court for compliance.
