% 05.10.2015 After some hearing, learned counsel submitted that the appeal may be disposed of giving it open to the parties to make submissions on merits as to the issue of territorial jurisdiction in the pending suit CS(OS) No.335 of 2004. The para 12 of the impugned order dated 23.10.2013 reserves such liberty. The contentions of the parties are, therefore, kept open in this regard.

The appeal is disposed of in above terms.
