BAIL APPLN. 1561/2016 and Crl. M.B. No.1428/2016 Issue notice. Mr. Katyal accepts notice on behalf of the State. The submission of learned counsel for the petitioner is that respondent No.3/ complainant has got the FIR registered in Lucknow even though the parties were residing at Delhi throughout and the alleged offence has also been committed at Delhi, if at all, and the Courts at Lucknow have no
jurisdiction in the matter. He further submits that the petitioner No.1 and respondent No.3 have been married for the last 13 years and the complaint of respondent No.3 is an afterthought. The parties have three children out of their wedlock.
Considering the fact that the FIR has been got registered at Lucknow, the petitioners are granted interim bail for a period of three weeks so as to enable the petitioners to approach the concerned Court to seek appropriate relief.
