% 19.01.2017 After some arguments learned counsel for the petitioner does not press the present petition to the extent it challenges the order dated 8th April, 2016 passed by the learned Additional Sessions Judge. He however states that the documents which the petitioner sought to place on record were not defence documents but certified copies of the orders/ judgment passed by the competent Courts in different proceedings and he would be at liberty to put the same in cross-examination to the complainant and witnesses of the complainant.

Needless to state that while cross-examining a witness the opposite side has every right to confront the witness with the documents it so desires even if those are not the complainant's/ prosecution's documents. Thus, CRL.M.C. 2795/2016

the petitioner is permitted to withdraw the present petition with liberty as prayed.

Petition and application are disposed of.
