W.P.(C) 6793/2016 & C.M. No. 27903/2016 (stay) Petitioner is stated to be a squatter near the Mother Dairy Both, Sarojini Nagar Market, New Delhi. He has filed certain documents which are per the Department are only prosecution challans and do not vests any right in favour of the petitioner. Be that at it may, learned counsel for the petitioner submits that he is protected under Section 3(3) of the Street Vendors (Protection of

Livelihood and Regulation of Street Vending) Act, 2014. His further submission is that he is still squatting at the site. This position is disputed by the learned counsel for the Department. It is, however, admitted that Town Vending Committee (TVC) qua respondent no.1/ New Delhi Municipal Council has been constituted and survey has been initiated by the TVC.

This petition is disposed of with liberty granted to the petitioner to approach the TVC who shall address the grievance of the petitioner in accordance with law.

Petition disposed of.
