The present application has been filed by the appellants seeking leave to withdraw the present appeal on the ground that after the last date of hearing, the parties have arrived at a settlement as recorded in the order dated 24.08.2017, passed by the learned Company Judge in CO.PET.779/2015. A copy of the said order has been enclosed with the present application.

Though an advance copy of the present application has been served on the respondent No.1, the contesting respondent, none is present on his behalf. It is assumed that the respondent No.1 does not wish to oppose the present application, particularly, in the light of the subsequent developments.

Accordingly, the application is allowed. The appeal is dismissed as withdrawn alongwith the pending applications. 4.

The dates fixed before the Registrar on 14.09.2017 and before the court on 27.11.2017, stand cancelled.
